LA DELIMITACIÓN ENTRE EL PODER DE REFORMA Y EL PODER CONSTITUYENTE: CONTROVERSIAS CONCEPTUALES
Resumo
El estudio examina las fronteras entre el poder de reforma constitucional y el poder constituyente, abordando las controversias conceptuales que surgen en la teoría y en la práctica jurídica. El análisis se basa en tres conceptos distintos de 'constitución' — extensional, formal y material — y propone un enfoque integrador que considera tanto aspectos formales como de contenido para delimitar los poderes de reforma y constitución.
