MENTAL HEALTH IN THE WORK ENVIRONMENT AND THE RIGHT TO DISCONNECT IN THE CONTEXT OF A PANDEMIC

Abstract

COVID-19's containment measures had reflexes on social life and impacts (in the short, medium and long term) in industries, companies, commerce, tourism, governments and, mainly, in the way of development of the work organization. With the changes driven by social isolation, workers were conditioned to share their own residential space with work activities, thus transforming their space for rest and disconnection into a work environment. In addition, given the information technologies and the control exercised by employers, workers started to develop their activities in their private social networks and through their own communication networks (WhatsApp, email and social networks), becoming hyperconnected with the working environment. Although there is a legal provision regarding the limitation of working hours, this is not verified in the new type of work (home office), putting the worker's mental and physical health at risk. Thus, this research aims to address the relationship between the work environment, labor hyperconnection and mental health in the context of the COVID-19 pandemic. In this way, the aim is to discuss the impacts of the pandemic on the mental health of workers due to labor hyperconnection. Therefore, the research was developed using the hypothetical-deductive method, combined with bibliographic and documentary research techniques.

Author Biography

Norma Sueli Padilha, Universidade Federal de Santa Catarina - UFSC

Post-doctorate in Environmental Ethics at the IFCH at the State University of Campinas - UNICAMP (2012). Doctorate in Diffuse and Collective Rights from the Pontifical Catholic University of São Paulo - PUC / SP (2004) and Master's in Social Relations Law from the Pontifical Catholic University of São Paulo - PUC / SP (2000); Adjunct Professor at the Federal University of Santa Catarina - UFSC, Coordinator and Permanent Professor of the Doctoral and Master's Program in Law at UFSC; Collaborating Lecturer at the PPGD at the University of Fortaleza - UNIFOR; Associate Professor at the Federal University of Mato Grosso do Sul - UFMS (retired). He served as Permanent Professor of the Doctoral and Master's Program in International Environmental Law at the Catholic University of Santos - UNIANTOS (2010-2018) and Permanent Professor of the Master's Program in Fundamental Rights at UNIVEM (2003-2010); Academic performance in the area of ​​Constitutional Environmental Law, Labor Environment, Labor Law and Labor Process, International Environmental Law, International Human Rights Law, Diffuse and Collective Rights and Collective Procedural Guardianship. He has experience in Public Law (AGU) and in private law. Author of the work awarded with the Jabuti Prize 2011 in the right category: "Constitutional Fundamentals of Brazilian Environmental Law". Managing Editor of Sequência Estudos Jurídicos e Politicos magazine; Honorary Member of the National Council for Research and Graduate Studies in Law - CONPEDI. Member of the board of APRODAB - Association of Professors of Environmental Law in Brazil. Leader of the Environment, Work and Sustainability Research Group, registered with the CNPQ. Lecturer, reviewer and reviewer of scientific journals. Collaborating Professor at the National School for the Training and Improvement of Labor Magistrates - ENAMAT.
