THE THE OBLIGATION TO RESPECT HUMAN RIGHTS IN BRAZIL AND THE POTESTATIVE POWER OF THE PRESIDENT OF THE REPUBLIC OF FIRMING INTERNATIONAL TREATIES

The dignity of the human person is one of the foundations of the Republic and the mainstay of the democratic rule of law. It follows from this axiom the provision of art. 4, item II, of the Federal Constitution, according to which Brazil is obliged to strive for the safeguarding of human rights in its international relations, having safeguarded the protective principles arising from treaties and conventions to the level of fundamental rights, provided that they are signed by Brazil (art. 5, § 2, of the Federal Constitution). The scope of such rights - which must be lived up to the consecration of the dignity vector of the human person and which are legitimized by the observance of the due international legal process in its construction - seems to be contradictory with the private and discretionary power of the President of the Republic to enter into international treaties, conventions and acts (art. 84, VIII, of the Federal Constitution), subject to referendum by the National Congress (art. 49, I, of the Federal Constitution). The present text intends, precisely, to analyze the compatibility between such principles, both coming from the original constituent, in the sense of affirming the existence of a link between the Chief Executive regarding the assurance of the full effectiveness of Human Rights in Brazil.
