Abstract

What are the limits and possibilities of constitutionality control in the Global South for the realization of social, economic and cultural rights (DESC's)? The present study aims to investigate, based on the assumption that there are no single action proposals for the judicial institutions, the answer to that question. The deductive approach is used in order, first, to present the general debate about the justiciability of DESC's and to disentangle the assumption that the rights of the first, second and third generation are interwoven. In a second step, through bibliographic-documental research, the theories Mark Tushnet, David Landau and Rosalind Dixon are worked on with regard to the performance of the courts in the face of the judicialization of these rights and the consequent need to make them effective in fragile democracies and complex realities. At the end, there is a proposal for a multifaceted and contingent judicial activism, which understands the possibility of judicial intervention in the execution of DESC's provided that there are institutional dialogues.
