It addresses, in this essay, the theoretical foundations of the second movement Law and Economics, especially if considered from the works of Richard Posner. Commends itself therefore the ideological and political model assumed and observed critically the development of the efficientist theoretical aspect applied to the right. Finally, we emphasize the mismatch of the second movement Law and Economics in relation to the contemporary model of rule of law.
