THE AUTHORITY OF JURISDICTION IN THE BIRTH OF MODERN LAW

The text discusses how disputes over the power of law over ecclesiastical and secular issues that were reflected in the Papal Revolution (11th century) were responsible for shaping the modern sense of jurisdictional authority. From Harold Berman's work the research presents the evaluation of some historical events that surrounded the social and political transformations in the second half of the medieval European. The contingencies of a radical change in social attitude towards law, the emergence of a methodology specific to the notion of legal science, the segmentation of law into distinct branches and the affirmation of specific professions are described. Thus, the article identifies the characteristic elements of the birth of modern forms of conflict resolution and their impact on jurists' discourses and practices.
