THE CASE OF UNIVERSAL COVERAGE OF HEALTH AND THE EVALUATION MADE BY THE PERUVIAN CONSTITUTIONAL COURT

This paper studies public policies and the fundamental right to health modeled on the evaluation of the Constitutional Court of Peru. The models under study are structured pluralism and the unified public health service in the perspective of the solidarity principle, with focus on the sentence of the Constitutional Court in Exp. No 00033-210-PI/TC, on which the supreme interpreter of the constitution analyzed, applying the right of equality and health, the public policy of universal coverage brought by Law n° 29344. The paper concludes that it is necessary to establish a guideline based on indexes to evaluate the health system of structured pluralism.
