ASSERTION THEORY
CONSEQUENCES OF ITS APLICABILITY IN BRAZILIAN CIVIL PROCEDURE

The paper focuses on the study of assertion theory and the consequences brought by its application and non-application. Due of the difficulty in distinguishing substantive law and procedural law in the application of the eclectic theory of action, there is a tendency to seek positive results with the implementation of the assertion theory in the moment of analysis of the conditions of action in civil procedure. The research is based on doctrinal, legislative and judicial studies of the action conditions in civil procedure. The study verifies the adoption by the majority of the assertion theory in the analysis of the conditions of action and the positive results of its implementation. The study observes that the non-application of the theory reveals undesirable results to civil procedure, that do not meet the Constitutional Model of Procedure. Indeed, the application of theory della prospettazione aims to optimize the adjudication remove the backlog in the courts, attributing to the effectiveness of Justice.
