HUMAN DIGNITY AS A FUNDAMENTAL RIGHT

Human dignity as a constitutional principle has an important legal-philosophical construction, in which it represents a true expression of individual autonomy to live freely and with dignity. Thus, this article analyzes and breaks the principle of human dignity in all its areas. For this, the discussion begins with the doctrinal revision of the principle of human dignity and, also, with the lifting of the international and constitutional regulations that surround the principle in question. After the construction of this theoretical-legal basis, the study presents a parallel of the individual's right to a dignified life, such as a dignified death, and for the latter it is presented with the analysis of laws 26529 and 26742 and the case The DMA Court of the Supreme Court of Justice of the Nation.
