Positivism is the right position by the Legislature of the State and has its uses, among them, to ensure legal certainty. However, not only lives a legal society. The development calls for new social rights all the time and not always the existing law provides answers to the diversity of cases that are judged by the judiciary. The legal interpretation is no longer satisfied with a mere literal application of the law and the judiciary operators realized that the method of literal interpretation was not fully adjusted to a principled Constitution, so the neoconstitutionalism emphasizes the importance of morality and justice in the legal interpretation because this movement, the legal standard is applicable only if in addition to a valid, effective, efficient and effective, it is also fair. After the Constituition of 1988, the STF opened the doors to the ponderation of principles and the dignity of the human person.
