INTERNATIONAL DECISIONS AS MOTIVE FOR A NEW READING OF THE IDEA OF SOVEREIGNTY
THE CASE OF THE ARAGUAIA GUERRILLA

The protection of human rights has long ceased to be the exclusive object of national regulatory systems, drawn from the constitutionalist movement in the late eighteenth century in europe and america. The end of the second great world war brought the reality of the fragility of sole guardianship by the States, which led to the emergence of a new movement, the creation of International Courts on Human Rights.The present article presents brief analysis related to the demand presented against Brazil in the Interamerican Commission of Human Rights and later submitted to the Inter-American Court of Human Rights. The objective is consequently to trace remarks related to the existence of the rights of the personality and its relation with the development of a theory of the human rights and with an international system of protection. And to make considerations about the need for reinterpretation of the idea of sovereignty in the face of international decisions of these courts.
