SPECIAL JUDICIAL BRANCHES AS TECHNOLOGICAL AND AFFECTIVE JURISDICTION

Law number 9.099/95, in the time of its promulgation, presented itself as a concrete solution to surpass the general aspects of dysfunction that lie in the base of the credibility of justice, becoming a turning point in the judicial life of the nation. The value of the solution by affection allows that plaintiffs be united by love, and not separated by judgment, freeing themselves of the paternalistic dependence in the judiciary and, at the same time, feeling whole and satisfied with the decision. Only a theory of affection is capable of reducing the contained litigiousness that haunts the special judicial branches, as it permits a true social therapy as emancipatory solution to the individual, allied to an electronic process that offers the necessary instantaneity to adapt the original principles of celerity and effectiveness.
